INTRODUCTION

Morningside Nannies is a Houston, TX based nanny referral agency.  We collect information about you to carry out our business activities.

This privacy policy details how “Morningside Nannies” (“the Company”) collects and processes your personal data. This applies to website visitors, potential clients or candidates, clients, candidates, and third parties.

“Personal Data” is any information identifying about an individual, excluding anonymous data. This may include personal information like your name, contact information, date of birth, background information or information obtained via a reference or research regarding personal and work history and behaviors.

“Processing” or “Process” means any activity involving the use of Personal Data. This includes obtaining, recording, storing, or utilizing this data. It also includes the transmission or transferring Personal Data to third parties.

GDPR PRINCIPLES WE ADHERE TO

This policy has been updated to reflect the principles and safeguards set out in the General Data Protection Regulation (EU) (“GDPR”). This policy was last updated May 30, 2018.

The eight principles relating to the Processing of Personal Data set out in GDPR which require Personal Data to be and which we adhere to include it be:

HOW PERSONAL DATA IS USED

For example, to register you as a new client, we may gather identifying information about you and your family, including your contact information, payment, and transaction information to search for suitable candidates for your family and to process, manage and collect payments and fees in accordance with our client agreement, company policies and practices.

To register you as a new candidate, we may gather identifying information about you including your information to confirm your identity, contact information, and information on your work history, personal and criminal background, skills, and experience in accordance with our company policies and practices and in the authorization and disclosure provided to you.

We may also use your personal and technical information to manage our business relationship with you, in the use of analytics to improve our website, services, marketing and client and candidate relationships and to recommend products of services that may interest you.

USE OF COOKIES

We may use cookies to personalize and improve your online experience. A cookie is a text file that is placed on your hard drive by a web page server. Cookies are not designed to run programs or deliver viruses to your computer. One of the primary purposes of cookies is to provide a convenience feature to save you time. INFORMATION WE OBTAIN FROM OTHER SOURCES

In addition, we may obtain information about candidates from other sources such as job board websites, online resume libraries, online recruiting sites, references, personal recommendations, web searches and social media.

Such information shall be gathered and processed by us to facilitate compliance with our obligations to our clients and candidates. Additional information on sources we use to gather information can be found in our candidate disclosure and authorization form.

MARKETING COMMUNICATIONS

You may receive marketing communications from Morningside Nannies if you have

  • requested information from us or registered with us as a candidate or client; or
  • if you applied for one of our positions via a third party; or
  • if you have not opted out of receiving marketing communications

DISCLOSURES OF YOUR PERSONAL DATA

We may have to share your Personal Data with the parties set out below and in section 3 above.

  • Clients who are looking for suitable candidates to fulfil a role they are offering.
  • Candidates who are interviewing with clients regarding a role they are offering.
  • Third parties who provide information regarding a candidate or client.
  • Service providers who provide IT and system administration services.
  • Professional advisers including lawyers, bankers, auditors and insurers who provide consulting, banking, legal, insurance and accounting services.
  • Other branches of Morningside Nannies, our affiliate businesses under Longhorn Leads, LLC and other agencies
  • Third parties to whom we sell, transfer, or merge parts of our business or our assets.

We require all third parties to whom we transfer your data to respect the security of your Personal Data and to treat it in accordance with the law. We only allow such third parties to Process your Personal Data for specified purposes and in accordance with our instructions.

INTERNATIONAL TRANSFERS

We occasionally have clients and candidates outside of the United States seeking to do business with our agency. When applicable, we may collect, process or transfer data from and to sources outside of the United States.

DATA SECURITY

We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed.

In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only Process your Personal Data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

DATA RETENTION

We will retain your Personal Data for as long as we deem necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, tax, or reporting requirements.

In some circumstances you can ask us to delete your data and it is our responsibility to make sure that any Personal Data we retain is accurate. So, if you would like us to erase your data (to the extent that we are able) or there are any changes to your data which means what we currently hold is inaccurate, please contact us immediately and allow 7-14 days for a response.
